Default ENS sponsored and it's being withdrawn at last minute

Hi All,

Hope someone can really give us some guidance and help.

We came to Melbourne in 2012. My spouse was given 457 sponsorship for a job transfer to Melbourne. Part of the job transfer, ENS was promised as well.

Everything went on well but when the ENS process came to Police check and Immigration also requested for an employment letter to state that my spouse would be hired at least 2 years more permanently. At this point the company HR informs my spouse that the he is longer required due to "business need" are not there and they cannot proceed to give the letter. Everything was paid for ENS nomination by the company (the lawyers said so) but we really don't know why the company is doing this at the last minute. We even got our Medicare card.

We have 3 school going children and really confused on how to proceed.

We are getting job offers but the companies are staying away due to our visa status. Really hope someone can shed some light on this matter.

Thank you.

Hi, there is little you can do unfortunately except withdraw the application and try and get the VAC refunded, unless your spouse can convince the employer to reconsider .

Otherwise he has to try and find another sponsor or see if he qualifies for one of the skilled visas.

How much longer is your 457 valid for ? What qualifications does he have ?
