Obligations of employer after 856 granted

Default Obligations of employer after 856 granted

I received my 856 Sponsored PR some time ago and currently moving companies under good circumstances.
My current employer has said that they have some obligations to DIAC for a long period of time after visa was granted, and they would like to transfer this obligation to my new employer.

The question I have is:
1. What are their long term obligations to the DIAC
2. Is there a form or method of transfering such obligations?

Not sure what obligations you mean. Is your employer maybe thinking about sc. 457 obligations ?

Hi Nick,
They said as on a year ago, the requirements changed and the sponsor of an 856 had to keep the DIAC informed of my whereabouts and earnings for a period of x years (I think 3). That plus a few other obligations. I can't find any reference to any post granting obligations.

They say they want to transfer these obligations onto the new employer hence asking.

Maybe you should just ask your employer for a copy of the obligations you are referring to.

Hi Brett,

I have a feeling that your employer wants to retain your services. I feel what they are saying are just excuses to discourage you from moving to another company.

As Nick suggested, you better ask for a copy of the obligations he is referring to.

Obligations

Under the Employer Nomination Scheme:

the employer must comply with all relevant Australian standards and workplace legislation for wages and working conditions
the employee must comply with all Australian laws as a permanent resident

I am not aware of there being any other conditions or obligations for a 856 visa holder other than the contractual obligations between him/her and the employer.

I checked the regulations and there is nothing new there. I would like to see a copy of the "obligations" your employer is referring to.
