PMV visa refused

Default PMV visa refused

Hi

My fiancee's PM visa application has been refused on grounds of
300.216 and 300.221.

Basically they have a doubt that my fiancee's divorce was not genuine as the consulate could not ascertain her claims through contacting her friends on top of a divorce certificate. Secondly, there were some inconsistancies in our answers and last but not the least, they doubted that our committment to each other could have ascentuated through our first gathering.

Yet, the Consulate have exclued information and evidence provided that could be to our advantage.

My question is (I know it is a hard one to answer) whether it is best to involve an immigration lawyer to represent us in this case or an migration agent? Could you please give me some hints of the possible fees involved in either scenarios. If I represent myself, would it be a risky move?

Without having access to all the facts and relevant documentation, I believe the quickest way would be to lodge a new, well-prepared application with all documentation properly taken care of and with good, consistent evidence .

You can either use a migration lawyer or a registered migration agent. Use someone you feel comfortable with and whose fees you can afford.

Fees can be anywhere between $ 2000.00 and $ 7000.00. I believe most Australian based agents would charge somewhere between $ 3000.00 and $ 4500.00.

An appeal would probably take longer and cost more than a new application and might ultimately fail. A reputable migration agent would caution you against proceeding with lodging an application without sufficient evidence/documentation.
