Hello

My name is Dan and I am new to the forum.

Here is my situation I hope you are able to help me, i am a little unclear about a few things!!

I have done a lot of reading on the immi website and some forums.

My boyfriend is British and here on a working holiday visa. We met when I lived in England and he moved to Australian in Dec 09 and his visa is due to expire end of December 2010. I am Australian and we want to apply for a Partner Visa.
Our 12months living together will come up in December. We have all the necessary proof that our relationship is legitimate etc.

Now here is where i am stuck. If we lodge the application in December, does he automatically go onto a bridging visa or some sort temporary visa until the application has been approved? Or do we need to apply for a bridging visa, will he be able to continue to work? Or If the visa is not approved by the end of December, will he need to leave the country?

I know i am not leaving a lot of time, between visa’s, I just want to get it all right first time round and to make sure we have the 12months living together secured. Most of my confusion is around the lodging of the application and what happens when going from WH Visa to a Partner Visa.

Your help is greatly appreciated!!!
Thanks

Hi Dan, the onshore application for the Partner Visa is also an application for the Bridging Visa. As soon as your partner's WHV expires, the Bridging Visa (A) will come into effect. The Bridging Visa will have the same conditions as your partner's last visa. If your partner wants/needs to travel overseas, make sure he applies for a Bridging Visa B, as the bridging Visa A will not allow him to travel back to Australia.
