Hello, everyone,

i just granted my permanent residency 2 months ago, now my husband wants to get seperate with me.

Our main problem is he doesnt wanna have sex with me unless i want to get preganent. I cant accept it and told him to go and see a doctor, but he denied. So we havent been "together" for more than a year and a half.

He still think it is my fault and feel very frastrated. Weeks ago we had problems again, and he told me to finish the relationship.

Im uncomfortable in the relationship, so i will accept the seperation if he insist. But will this affect my visa by any chance? Does anybody know a good lawyer that i can get help from?

If you have permanent residency, then you'll have no problem in regards to your visa.

I take it you were on a temporary spouse visa for 2 years and then got PR ?

Please confirm if that is the case or contact me privately if you prefer.

Yes, i applied TR (subclass 309) in 2008 oversea and got my PR (subclass 100) in australia 2 months ago.

He doesnt talk to me now, so i dont know whether he is going to report me to the immingration. But i have heard the visa could be reviewed and cancelled by MRT, will it applied to my case?

What should i do to avoid this problem?

You are a permanent Australian resident and as such you should have nothing to worry about. The visa would only be revoked if the application was in some way fraudulent.

I think you should go and see a family lawyer, a women's support group or a Migrants Resource Centre.

can i ask you two more questions?

If somebody report me to the immigration department, is the MRT gonna review just my PR application documents or are they gonna review my TR application documents as well?

Also, is a registered migrant agent or a lawer able to ask the immigration department to give him the copy of my application documents to review? Or is it nobody can get those documents, only the immigration department will conduct an investigation themselves?

The MRT has nothing to do with it. They deal with visa refusals and cancellations. If your visa was cancelled (depending on the grounds for cancellation )you might be able to appeal the decision at the MRT.

The department could investigate you and cancel your visa, if your application for the temporary or permanent spouse visa was fraudulent.

If you now have PR and you have abided by the conditions of your temporary spouse visa, then you have nothing to fear.

If you are worried, contact one of the organisations I mentioned in the previous post or engage a registered migration agent.

You can get a copy of your documents from DIAC by making a Freedom of Information (FOI) request or you can get a migration agent or lawyer to do it for you.
