Hi, I am a new in this forum...Wanted your help in udertanding what actually is meant as genuine visit when applying for 676 Tourist visa. Recently, my cousin applied for a 676 visa to Australia but got it rejected saying that the visit doesnt sound to be genuine and also you have mentioned that you have a cousin in australia but not have provided the evidence of the relationship with them and also that the proof that they will be supporting you in Australia. My cousin does not have a full time ongoing work, she lives with my parents who are both doctors and helps them in running their hospital and in return she gets some money from time to time but its not a fixed income. My parents normally bear most of her expenses like food and accomodation. Also, when she applied for the visa, she provided all her financial evidences (whatever she has) and i had also sent a letter of invite in order to invite her, saying that i will bear all her expenses while she is in Australia. I also provided my passport copy and financial income proof. I havent visited my family and her in last 2 yrs so i dont have any latest photos with her but have some photos with family in which she is also present which are from the time when i visited my family and her last i.e. 2 yrs back. If I provide those photos, will it help? Please advise as her visa is now refused, can she re-apply the visa straight away or will she have to wait for some time to re-apply, if we can apply again what can we do best to get her visa approved this time? Please advise. Thanks in anticipation.

What country is your cousin from?

Yes, she can re-apply, but she will need to supply a lot more information, as they will refer back to the previous refusal and look for similarities.

If she's from a poor country, they worry that the person is planning on overstaying and working illegally. People do this all the time, and it's considered to be a major problem. They need to see evidence that your cousin has MORE reason to return to her country than the reasons she would have to stay in Australia illegally.

Hey Jeff, thanks for the reply. My cousin is from India. Can she re apply straight away without any wait for any time period. Also, what evidence should we provide as a proof of our relationship. She is a daugter of my father's brother. Also, what else can we provide to show that she will return back, she doesnt have much assets in India. But she has her family in India. Do you suggest it will be good if I provide a Stat Dec saying that I will be responsible for her return to India and also for her expenses in Australia while she is here. Please advise. Thanks in advance.

- Statutory declaration from yourself, offering support.
- Evidence of your own financial stability, eg. tax returns, bank statements
- Her birth certificate (full birth certificate, showing her father's name), plus YOUR birth certificate showing YOUR father's name.
- The photos that you mentioned.
- Affadavit or Statutory Declaration (whatever they use in India) from your father, stating that (a) she is their neice, (b) that she is employed by them, and (c) assuring the continuity of her employment with them

HOPEFULLY that will be enough.

I do most of my work here in the Philippines, and India has a similar reputation and similarly high incidence of overstayers! Therefore they scrutinise applications very closely. It MAY be impossible. I haven't had the experience with Indian visas to tell you, but it wouldn't surprise me.

And she may re-apply anytime. Just make sure she's 100% ready, and make sure she doesn't get cranky, OK? And don't YOU do they "I'm an Australian Citizen, and I demand that you......." thing. Case Officers can take a dislike to somebody, and they have a lot of power.
