View Full Version : Canceling temporary partner visa

Hi! I had applied with my partner for the 12 months visa (de facto) 2 years ago. We received the visa approx 1 year ago.
I am her sponsor.
Unfortunately, things are not working out very well and I no longer wish to be her sponsor.
I cant live with her anymore.
I wanted to check what would happen if I called and canceled my sponsorship.
Will she be forced to leave the country ? Or is she able to stay but just live separately ?
I am trying to end this relationship by causing the least amount of harm to her, and would like her to stay, but just not with me, and without me sponsoring her.

She is here in Australia because she married you. She is here wholly and solely because she is the wife of an Australian Citizen or Permanent Resident. If she ceases to be, then she ceases to have a reason to be here. That's the Law.
If she ceases to have a sponsor, ie. if you withdraw your sponsorship, then her SC820 visa is cancelled. Again, that's the law.
It's obvious that you're trying to be a gentleman about it, and you would like her to stay. But under the Law she ceases to have any right to stay. It's not nastiness on your part. It's just the Law. None of us have a right to say "I want this person to stay". It's not your power to give this to her.
And If you stay together and pretend that you intend to stay with her forever, when it fact you no longer have these intentions, you are committing fraud.....which is a serious offense.
It seems harsh. I respect that you're trying to be kind, truly. But you have to do what you have to do.

Good! I'm glad.
At least it takes the "bad guy" thing off your shoulders! You're not punishing her. You're simply following the Law. And it's not "parking fine" stuff if you don't tell the truth. It's massive fine stuff, and jail stuff.
