hi every 1.i am new to this forum and i need help with partner visa application.
i came to Australia 2.4 years ago on a student visa. My partner is a permanent reisdent here and she came to Australia around 2.5 years ago.i met my partner 1.5 years ago and fell in love. she got pregnent straight away and now we have a 4 months old baby. our kid got the australian passport straight away because of his mother's PR visa. and by the way i have been in relationship with this girl for 1.5 years and we used to spend most of the time together but i officially moved in with her around 5 months ago just few weeks before she gave birth. we are planning to get married soon
i am just wondering whether she will be eligible to sponser me for partner visa because as i mentioned she came 2 Australia 2.5 years ago and she never worked her.she has been recieving money from Centerlink for last 2 years.
do you think that the fact we have a newborn baby who's Australian citizen would help in visa application?
what do you reckon would be the best visa option for me?

Thank you for posting in the Migration Help forum. In my years of handling spouse and partner visas from various countries including mail order brides’ cases from Eastern Europe, we have been able to address all the issues up front in the application and thus achieve 99% success rate. I have had only one refusal from Vietnam which got me so angry with the Case officer, that I virtually constructed a "manual" and won at the MRT for that one case. That MRT appeal has been abridged and the Admin of this forum has posted it in the forum.
In my experience every spousal relationship visa has been genuine, and if I do find one that is contrived I do not accept to act for the applicant. The Department knows my integrity.

Having a child certainly strengthens the case to evidence a genuine relationship.

Im new here, i hope you can give some advice in my situation.

Im a permanent resident of aussie and i am 5 months pregnant to my 2 year boyfriend in the philippines. Now, i am planning to go back to philippines to get married to my boyfriend by june2010 and to sponsor him for spouse visa offshore asap, we already have all the documents that we might needed, i am planning to go back to aussie when the application is approved. But i am still worried, is there any chances that the application will not approved? how long does the application will take? and what is the best option for my situation?

Please guys help me. it would be much appreciated for all responses. Thank you

There's ALWAYS a chance it won't be approved. The way the Migration Law works is that for each visa there is a lengthy set of regulations. By law if the visa application meets all of those requirements set out by the regulations, they MUST give you a visa. But by law if the application does NOT meet all those requirements, then they must NOT give you a visa.

Therefore it's extremely important to get everything right on the application, and to have the application prepared in such a way that the Case Officer looking at the application gets a very clear picture in their mind of who you and your fiance are, and what your situation is. If they see and believe that you are both sincere in your intentions (and that you meet all the regulations), then you will have a successful application and a visa grant.

Time taken? From the time of application, anywhere between 2 and maybe 9 months? 3 - 6 months is fairly standard.

Best option is to use an experienced Migration Agent......one who is REGISTERED with MARA, and not one of the dodgy unregistered ones that Manila is full of.

thanks for the quick response. but one more thing, regarding to the witness statutory declaration form 888, i have a problem with that. what if i really don't have any witness who is pr or citizen to be my witness for my relationship to my boyfriend for 2 years?except for my mum holding a pr visa, and they said that it is required to submit atleast 2 witness statutory,is there any problem if i only have 1 witness which is my mum? i am so confused.

Thanks for the advice.

It's not written in Law that you "must have two x Form 888". It's their preferred method. But if you really don't, then you really don't. They can't deny an application due to that. This is only one form of evidence. Again, I suggest you use a good Migration Agent who is MARA-registered, and is experienced in this area.
